Terms and conditions

Introduction

These General Terms and Conditions (“GT&C”) govern your use of the EizabethOnFood Amsterdam App and of the website www.elizabethonfood.com (hereinafter referred to together as: “the Offer”). By using the Offer, you accept these GT&C in full. If you disagree with any part of these GT&C, you must not use the Offer.

Intellectual property rights

Unless otherwise stated, EoF Europe BV and / or its licensors own all intellectual property rights related to the Offer. Subject to the licence below, all these intellectual property rights are reserved.
Any and all texts, symbols, pictures, and other contents in the Offer are protected by copyright law and other laws and treaties relevant to intellectual property. Thus, it is strictly prohibited to use such contents absent the prior written consent of EoF Europe BV. “ElizabethOnFood” is the registered trademark of Elizabeth Auerbach. Therefore, the law strictly prohibits the use of term “ElizabethOnFood” absent her prior written consent. Further, it is strictly prohibited to quote or reprint a part or all of contents of the Offer.

License to use the Offer

You may view, download and print pages from the Offer for your own personal use, subject to the restrictions below. You must not:

(i)        republish material from the Offer (including republication on another website);

(ii)       sell, rent or otherwise sub-license material from the Offer;

(iii)      show any material from the Offer in public;

(iv)      reproduce, duplicate, copy or otherwise exploit material from the Offer for a commercial purpose

(v)      redistribute material from the Offer [except for content specifically and expressly made available for redistribution (such as our newsletter).

Limitation and exclusion of warranties and liability

Although the information in the Offer was believed by EoF Europe BV to be accurate and current at the time of publication, and every reasonable effort is made to keep the information contained in the Offer up to date, EoF Europe BV cannot accept responsibility for any inconvenience, loss, or injury sustained by any person relying on information or advice contained in the Offer. Things change over time and users of the Offer should take steps to verify and confirm information, especially time sensitive information related to prices, hours of operation, and availability.

To the maximum extent permitted by applicable law, EoF Europe BV excludes all representations, warranties and conditions relating to the Offer and the use of the Offer (including, without limitation, any warranties implied by law in respect of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill).

Nothing in these GT&C will limit or exclude our or your liability for fraud or fraudulent misrepresentation, limit any of our or your liabilities in any way that is not permitted under the law, or exclude any of our or your liabilities that may not be excluded under the law.

To the extent that the Offer is provided free of charge, Eof Europe BV will not be liable for any loss or damage of any nature. To the extent that the Offer is not provided free of charge, any liability for EoF Europe BV is hereby expressly limited to the net amount charged to you after taxes and fees for Apple and / or Google.

EoF Europe BV will not be liable to you in respect of any losses arising out of any event or events beyond its reasonable control. EoF Europe BV will not be liable to you in respect of any business losses, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill. EoF Europe BV will not be liable to you in respect of any loss or corruption of any data, database or software. EoF Europe BV will not be liable to you in respect of any special, indirect or consequential loss or damage.

Variation

EoF Europe BV may revise these GT&C from time to time. The revised GT&C will apply to the use of the Offer from the date of the publication of the revised disclaimer.

Law and jurisdiction

These GT&C will be governed by and construed in accordance with Dutch law, and any disputes relating to these General Terms and Conditions will be subject to the exclusive jurisdiction of the Court in whose district EoF Europe BV is established.
